Terms & Conditions

  1. Definitions
    1. ‘BIKER STREET’ shall mean Biker Street Buenos Aires Biker Tours. 
    2. ‘CUSTOMER’ shall mean the person in whose name the booking is made and shall include the person or persons on whose behalf the same booking is made. 
    3. ‘Force Majeure’ shall mean any event outside BIKER STREET’s control, including but not limited to war and civil strife etc., which prevents the prompt performance of its obligations.
  2. General Information
    1. Please read the following Terms and Conditions carefully before proceeding with your booking. These Terms and Conditions are subject to change without notice, from time to time, in our sole discretion. BIKER STREET will endeavor to communicate the most updated Terms and Conditions to our CUSTOMER(S) when changes occur. These general terms and conditions apply to all contracts between BIKER STREET and CUSTOMER(S) for bike tours.
    2. The contract incorporating these conditions shall be governed by Argentine law and any matters arising out of it shall be subject to the jurisdiction of the Courts of Argentina, Ciudad Autónoma de Buenos Aires.
  3. Website
    1. General information included in the website (www.biker-street.com) is for help and guidance.
  4. BIKER STREET
    1. BIKER STREET agrees to provide cultural guided bike tours around Buenos Aires City. 
  5. Bookings
    1. The CUSTOMER who performs a bike tour with BIKER STREET is subject to these terms and conditions. All bookings are made in accordance with and subject to these terms and conditions.
  6. Tours
    1. A regular group tour lasts between 4 – 8 hours. On the occasion that an attraction is closed or the group experiences an unforeseen event (flat tire, protest, etc.) the tour may last more or less than the originally stated time. 
    2. The routes are fixed; however, due to unexpected road closures, protests, traffic, etc., BIKER STREET sometimes will have to find the next best alternate route. 
    3. The minimum number of CUSTOMER(S) to start any group tour is one. In that case, the CUSTOMER(S) will not need to pay any extra fee for participating in a private tour.
  7. No Show and Late Arrival Policy
    1. If the CUSTOMER does not arrive to the corresponding meeting point at the arranged meeting time to start a tour (10 minute window) or does not give any notice beforehand, it is considered a “no-show.” No refund whatsoever will be issued to no-show CUSTOMER(S). In order to avoid any inconvenience, BIKER STREET recommends arriving to the meeting point 10 minutes prior to departure time.
    2. In any situation where the CUSTOMER(S) do not show up for their scheduled tour and they are the only CUSTOMER(S) in the tour, BIKER STREET reserves the right to cancel the tour after 10 minutes of waiting, unless notification of late arrival has been made in advance.
    3. If a CUSTOMER arrives late to a tour, BIKER STREET reserves the right to alter (shorten) the itinerary accordingly in order for the tour to end at the agreed upon time.
    4. Tours start and end as scheduled by BIKER STREET. If a CUSTOMER arrives late, the tour time missed is not refundable, and any down payment made in order to confirm the booking is not refundable either.
  8. Travel Documents and Insurance
    1. The CUSTOMER confirming a booking must be of legal age. CUSTOMER(S) under the age of 18 must be accompanied by an adult) who will be responsible for all equipment leased by them or the members of their group.
    2. The CUSTOMER is fully responsible for ensuring that they have adequate travel documents, visas, travel insurance and medical / travel health insurance. Any non-compliance and any resulting damages are the sole responsibility of the CUSTOMER.
  9. Liability
    1. BIKER STREET is responsible for ensuring that all services are supplied as described and that they all reach reasonable standard. However, BIKER STREET will not be liable for the failure or improper performance of these products and services where such failure or improper performance is attributable to i) the fault of the CUSTOMER, ii) the unforeseeable or unavoidable actions of an unconnected third party, iii) unusual and unforeseeable circumstances beyond BIKER STREET’s control, including force majeure. 
    2. BIKER STREET will not be held liable for loss, damage or injury to persons or property. 
    3. BIKER STREET is not liable for any damage resulting from or compensation related to incorrect or withheld information received from the ‘CUSTOMER’ at the point of booking.
  10. Prices
    1. The prices stated on the website are the official charges; prices in any printed flyers, brochures, advertisements or other materials are for indication only. Prices are subject to change at any time. 
    2. In the case that only partial payment was made by a CUSTOMER and the prices changed, it is at BIKER STREET sole discretion to decide whether to honor the price from the time of booking to the CUSTOMER upon completion of the full payment or cancel the booking and refund the down payment.
  11. Discounts
    1. Discounts that are offered directly by BIKER STREET cannot be combined with any other discounts offered by third parties, unless stated otherwise.
    2. Discounts offered by BIKER STREET for private group tours are at BIKER STREET sole discretion. They are subject to change at any time if the original agreement changes. 
  12. Booking and Payment
    1. Due to the limited capacity of each tour, spots are available according to previous reservations and then on a first come, first served basis. Therefore, the spot is not guaranteed and booking is not finalized until the down payment is completed and a confirmation message has been issued. 
    2. As BIKER STREET is a Trust Protects Provider, the consumer is protected for the value of any validated payment made to BIKER STREET in the event of their failure.
    3. Payments in foreign currency could be made in United States Dollars (USD) or Euros (EUR)
  13. Special Requirements
    1. Any special requests must be advised to BIKER STREET at the time of booking the tour, in writing.
  14. Cancellation, Rescheduling, Refund and Rain Policies
    1. If a CUSTOMER wants to cancel or reschedule a booking, the request must be made to BIKER STREET in writing. The date/time of cancellation or rescheduling will be the date/time that BIKER STREET receives the letter or email.
    2. Rescheduling Policy
      1. If a CUSTOMER wants to reschedule a booking, BIKER STREET offers 100% credit to a tour of less or equal value in the future, without charge, if BIKER STREET is notified more than 24 hours before the tour starts. The rescheduled date will depend on BIKER STREET tour schedule availability. In case BIKER STREET tour schedule availability does not match the CUSTOMER’s availability, the payment made will not be refundable. 
      2. Any rescheduling request received within 24 hours of the start time will be considered a cancellation of the original booking. 
    3. Cancellation Policy
      1. If a CUSTOMER wants to cancel a booking, BIKER STREET will not refund the down payment made. In case full payment has been completed, BIKER STREET will only refund an 80% of the payment, if BIKER STREET is notified more than 24 hours before the tour starts.
      2. In case BIKER STREET is notified less than 24 hours before tour departure time, no refund will be issued.
      3. CUSTOMER must know how to ride a bike. BIKER STREET recommends having experience riding in city traffic. BIKER STREET will assess CUSTOMER’s skills to ride a bike. In case a CUSTOMER has poor skills riding a bike that could compromise their safety, BIKER STREET reserves the right to remove the CUSTOMER from their tour. No refund will be given, and the CUSTOMER must pay the full compensation for any damages that might have been caused.
    4. Chargeback fraud
      1. In case a CUSTOMER fraudulently opens a chargeback dispute and BIKER STREET contends that claim, submitting proof that the chargeback shouldn’t apply, according to these Terms and Conditions, the CUSTOMER will not only see a reversed chargeback deducted from their bank account but also another USD 40 deduction corresponding to a chargeback processing fee.
    5. Rain Policy
      1. In case of rain, it shall be assumed that the tour will be going as scheduled unless otherwise notified by BIKER STREET to the CUSTOMER. BIKER STREET reserves the right to modify departuretime by 30′ in case of rain. During those 30′, and in order to make the best of the tour time, BIKER STREET will offer the “mate” tasting that is included in the tour.  The tour shall end at the agreed upon time. BIKER STREET will cancel the tour in cases of extreme weather that compromises the safety of the CUSTOMER(S) which include lightning, thunder and/or flooding. In case weather conditions are not safe at the departure time, BIKER STREET will refund 100% of the down payment. 
      2. Once the tour has started, BIKER STREET reserves the right to alter (shorten) the itinerary accordingly in order for the tour to end at the agreed upon time. BIKER STREET will provide rain ponchos to mitigate the weather, if necessary. Therefore, it will at BIKER STREET sole discretion to cancel the tour if the conditions are not safe to continue. In that last case, the CUSTOMER will receive a proportional refund according to the route made. 
  15. Changes by BIKER STREET
    1. BIKER STREET reserves the right to modify or cancel its services arrangements if unforeseen circumstances arise. If BIKER STREET cancels or significantly changes the elements of a booked tour due to force majeure, on or before the start date of such tour, BIKER STREET will inform the CUSTOMER as soon as possible and will put its utmost effort to arrange alternatives that are of equal value. If force majeure occurs while the tour is in progress, BIKER STREET will try to make reasonable alternative arrangements as well.
  16. Codes of Conduct
    1. CUSTOMER(S) are expected to behave respectfully to others, including but not limited to fellow CUSTOMER(S), guides, staff and/or activity personnel, and to the property of others, including but not limited to shared facilities and public environment. Also, CUSTOMER(S) are expected to obey the laws and adapt to the customs of the country they travel in. The Codes of Conduct is outlined as such and serves as a guideline for all BIKER STREET CUSTOMER(S) to follow.
    2. BIKER STREET reserves the right to remove a CUSTOMER from his/her tour if such CUSTOMER violates the Codes of Conduct. No refund will be given, and the CUSTOMER must pay the full compensation for any damages that might have been caused.
  17. Privacy Policy
    1. All the personal information that is collected during the BIKER STREET registration process will be used for BIKER STREET administration and booking purposes only. BIKER STREET does not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services you’ve requested. BIKER STREET may occasionally send news, such as information on our current events, special events happening in Buenos Aires during the CUSTOMER’s stay, special promotions etc. to the CUSTOMER’s provided email address. CUSTOMER could always reply to be unsubscribed at anytime.
